Question

Criminal - marriage and du

Sent to Immigration Law Experts March 18 2:32 p.m.

I made a stupid mistake - I am married Denver Coloradon since 9/1987 to my wife. But we were separated for 3 months from 10/2003-1/2004. In 12/12/2003 I went to LasV egas, Nevada, I got drunk and married my girl friend at that time. Is the Las Vegas Nevada a legal marriage? I also just got a DUI on 3/5/08. Can I still apply for my citizenship? When I fill out my application for citizenship do I put the Las Vegas marriage? I am also studing to be an attroney as well. Will this hurt my law school/prevent me from being an attorney?

Dear Denver,

The Las Vegas Marriage is a legal marriage. If the marriage is less than one year old, it may be possible to have it voided or to get an annulment. Since I see it has been more than a year, it would not be possible to get this marriage voided unless it provided a circumstance of bigomy.

You can still apply for citizenship, but you will need to make sure all actions pertaining to the DUI are resolved: i.e. all fines paid, all classes completed, all probation served, etc.

this will not likely interferer with your law school if it is your only offence, and provided it is nothing more than a dui.

Unless you received a divorce you will have to indicate that you are married.

So am I married to 2 women, one in Las Vegas in another one in Colorado? Both marriages are valid? Will both marriages show up on my citizen background check?

Thank you.   Messy. I know. First marriage in 1987 is valid, (I want to keep). 2nd marriage in 2003 I need it annulled, do not want. So I will call the Clark county in Las Vegas Nevada and take care of paper work to removed the invalid marriage of 2003.
